Healthcare professionals often face ethical conflicts and challenges related to decision-making that have necessitated consideration of the use of conscientious objection (CO). No current guidelines exist within Spain’s healthcare system regarding acceptable rationales for CO, the appropriate application of CO, or practical means to support healthcare professionals who wish to become conscientious objectors. As such, a procedural framework is needed that not only assures the appropriate use of CO by healthcare professionals but also demonstrates its ethical validity, legislative compliance through (...) protection of moral freedoms and patients’ rights to receive health care. Our proposal consists of prerequisites of eligibility for CO (individual reference, specific clinical context, ethical justification, assurance of non-discrimination, professional consistency, attitude of mutual respect, assurance of patient rights and safety) and a procedural process (notification and preparation, documentation and confidentiality, evaluation of prerequisites, non-abandonment, transparency, allowance for unforeseen objection, compensatory responsibilities, access to guidance and/or consultative advice, and organizational guarantee of professional substitution). We illustrate the real-world utility of the proposed framework through a case discussion in which our guidelines are applied. (shrink)

In March 2021, the Spanish Congress approved the law regulating euthanasia, that regulates both euthanasia and physician-assisted suicide (PAS). In this article, we analyse the Spanish law regulating euthanasia and PAS, comparing it with the rest of the European laws on euthanasia and PAS (Netherlands, Belgium and Luxembourg). Identified strengths of the Spanish law, with respect to other norms, are that it is a law with many safeguards, which broadly recognises professionals’ right to conscientious objection and the specification that it (...) makes on the prior comprehensive care of the patient, including the approach to care dependency. Regarding its shortcomings, the law does not differentiate well between euthanasia and PAS; it barely assigns a role to the healthcare team as a whole (similar to other regulations); it does not clarify the functions of the different professionals involved; it does not detail the specific composition and duration of theevaluation commission; it has not been accompanied by a prior or simultaneous regulation of palliative care; and, lastly, the period of time to implement the law is too short. El aprendizaje de la Historia en Educación Secundaria se relaciona con un proceso memorístico y conceptual que dificulta la formación del pensamiento crítico y reflexivo en el alumnado de esta etapa educativa. Por este motivo, con esta experiencia y desde un enfoque investigativo, hemos fomentado la curiosidad y el interés de los alumnos de 1º de Secundaria por las prácticas religiosas y funerarias que profesaron los romanos. El método de enseñanza-aprendizaje fue activo y participativo, lo que facilitó la indagación y (...) la experimentación del taller “Funus romanorum”. Los resultados mostraron las ventajas de trabajar la arqueología experimental para comprender mejor los hechos acaecidos en la Antigüedad y adquirir contenidos históricos a través de talleres experienciales. Diante de uma crise sanitária mundial, a pandemia do COVID-19, iniciada em 2020, fez com a humanidade se reorganizasse, entrando em uma nova era. Os órgãos de saúde competentes, juntamente com as nações, expuseram suas preocupações, editando decretos e normativas a serem seguidas, com medidas rigorosas de isolamento social. E a Educação foi uma das áreas mais afetadas, por ser um dos pilares mais importante na sociedade moderna. A rotina que antes era totalmente presencial, passou a ser a distância, novas (...) ferramentas foram ganhando palco, as tecnologias entraram em cena, as mídias sociais passam a ser recursos, estratégias para novas abordagens, metodologias passaram a ser repensadas, reorganizadas, para oferecer uma educação de qualidade, mesmo em tempos de crise. E partindo dessa ideia, o presente trabalho visa discutir e compreender se toda essa mudança, essa troca de cenário de forma abrupta, e as estratégias conseguiram alcançar os objetivos propostos no processo de ensino-aprendizagem. A análise ocorreu em uma escola pública municipal da região norte de Cuiabá- MT, no período letivo de 2020 e 2021, sendo observadas o curso das disciplinas Arte e Educação Física, com um público de alunos variados, da pré-escola ao 3° ano do Ensino Fundamental I. The purpose of this text is to examine the nodal points of the interpretation of Bergson presented in “Bergson: Intuição e discurso filosófico”, by Franklin Leopoldo e Silva, in order to make explicit the originality of his circumscription of the problem of language in this philosophy that claims to be intuitive. We argue that the notions of limit and tension are mobilized by the author to demonstrate the inseparable relationship between the critique of discursivity and intuitive access to the absolute (...) that is duration. We will also try to show how this approach offers us a new look at the particular way in which Bergson links philosophy and the history of philosophy in his first work. (shrink)

O presente artigo se sustenta fundamentalmente em dois textos seminais de Franklin Leopoldo e Silva que representam uma contribuição essencial em meu caminho filosófico e especialmente na compreensão que desenvolvi e continuo desenvolvendo da filosofia bergsoniana. No meu modo de ver, tais textos iluminam, como poucos grandes textos, a originalidade, a importância e a potência de Bergson para o pensamento contemporâneo. Em diálogo com esses dois textos, associo, preponderantemente, textos do próprio Bergson e outros textos de Leopoldo e Silva, procurando (...) assinalar, a partir daí, o valor de suas filosofias em nossa formação ao integrarem pensamento, vida e história. Este artículo discute el problema de la permanencia y del cambio. Empieza considerando al esencialismo frente al anti-esencialismo contemporáneo, en un segundo momento, la noción de existencia y, en seguida, las de identidad y cambio. Finalmente, se apela a la naturaleza de la predicación para mostrar que, contra el esencialista, la concepción del cambio de su contrincante sí logra resolver el problema de la unidad semántica de la proposición.

1964 fue un año resolutivo en el arranque del proceso aplicativo de la reforma litúrgica. Aunque estos inicios han sido ampliamente estudiados por liturgistas e historiadores del concilio, el acceso a nuevas fuentes documentales pone a disposición de los investigadores un material que sirve para completar, complementar, enriquecer y abrir nuevas pistas a los trabajos realizados hasta la fecha. Es el caso del archivo personal de Jorge Medina, en el que se encuentran catalogados diversos documentos, los que contienen material relativo, (...) tanto al complejo trayecto de la actuación de la reforma litúrgica como a la primera recepción y aplicación de la constitución Sacrosanctum concilium en Chile. A la luz de esta documentación inédita, este trabajo, que tiene como telón de fondo la publicación del motu proprio Sacram Liturgiam, estudia las propuestas que, en materia litúrgica, el episcopado chileno elevó a la santa sede para poner en marcha la reforma en el país. In this paper we mainly study preservation theorems for two fragments of the infinitary languagesLκκ, withκregular, without the equality symbol: the universal Horn fragment and the universal strict Horn fragment. In particular, whenκisω, we obtain the corresponding theorems for the first-order case.The universal Horn fragment of first-order logic (with equality) has been extensively studied; for references see [10], [7] and [8]. But the universal Horn fragment without equality, used frequently in logic programming, has received much less attention from the model (...) theoretic point of view. At least to our knowledge, the problem of obtaining preservation results for it has not been studied before by model theorists. In spite of this, in the field of abstract algebraic logic we find a theorem which, properly translated, is a preservation result for the strict universal Horn fragment of infinitary languages without equality which, apart from function symbols, have only a unary relation symbol. This theorem is due to J. Czelakowski; see [5], Theorem 6.1, and [6], Theorem 5.1. A. Torrens [12] also has an unpublished result dealing with matrices of sequent calculi which, properly translated, is a preservation result for the strict universal Horn fragment of a first-order language. And in [2] of W. J. Blok and D. Pigozzi we find Corollary 6.3 which properly translated corresponds to our Corollary 19, but for the case of a first-order language that apart from its function symbols has only oneκ-ary relation symbol, and for strict universal Horn sentences. The study of these results is the basis for the present work. In the last part of the paper, Section 4, we will make these connections clear and obtain some of these results from our theorems. In this way we hope to make clear two things: (1) The field of abstract algebraic logic can be seen, in part, as a disguised study of universal Horn logic without equality and so has an added interest. (2) A general study of universal Horn logic without equality from a model theoretic point of view can be of help in the field of abstract algebraic logic. (shrink)

La discipli-na jurídica se configura en un contexto caracterizado por la convivencia y el concurso de varias fuentes y múltiples sujetos reguladores. Esto produce una relativización del principio de tipicidad de las formas y de las fuerzas nor-mativas, así como una creciente variedad de las reglas jurídicas, que oscure-ce su orden jerárquico. El sistema de las fuentes se desestructura, se (...) frag-menta y adquiere una dimensión reticular. En la fase actual de profunda reestructuración del paisaje jurídico el ordenamiento existe en la relación que conecta múltiples actos normativos, diversamente vinculantes. The widely accepted “continuing bonds” model of grief tells us that rather than bereavement necessitating the cessation of one’s relationship with the deceased, very often the relationship continues instead in an adapted form. However, this framework appears to conflict with philosophical approaches that treat reciprocity or mutuality of some form as central to loving relationships. Seemingly the dead cannot be active participants, rendering it puzzling how we should understand claims about continued relationships with them. In this article, we resolve this (...) tension by highlighting two fundamental aspects of paradigmatic loving relationships that can, and often do, continue in an adapted form following bereavement: love and mutual shaping of interests, choices, and self-concepts. Attention to these continuing features of relationships helps to capture and clarify the phenomenological and behavioral features of continuing bonds. However, love and mutual shaping must also change in important ways following bereavement. Love becomes unreciprocated, and although the dead continue to shape our interests, choices, and self-concepts, we predominantly shape their legacies and memories in return. These changes place important constraints upon the nature of our interpersonal connections with the dead. (shrink)

The shooting bias hypothesis aims to explain the disproportionate number of minorities killed by police. We present the evidence mounting in support of the existence of shooting bias and then focus on two dissenting studies. We examine these studies in light of Biddle and Leuschner’s “inductive risk account of epistemically detrimental dissent” and conclude that, although they meet this account only partially, the studies are in fact epistemically and socially detrimental as they contribute to racism in society and to a (...) social atmosphere that is hostile to science as scholars working on issues of racism come under attack. We emphasize this final point via recourse to Kitcher’s “Millian argument against the freedom of research.”. (shrink)

The stream on political corporate social responsibility argues that companies have recently assumed state-like roles to influence global governance. However, following emerging calls for greater contextualization of CSR, we trace the historic evolution of PCSR in the case of Colombia and argue that such political engagement by firms is not new. Looking beyond a linear chronological account, we reveal the sedimentation process behind PCSR by exploring the archetypical political roles businesses have taken on in providing public goods and acting as (...) regulators, and chart their transformation. Our findings allow us to make two main contributions. First, by unearthing different strata of business and society relations, we enrich the research on PCSR, highlighting its historical sedimentation dynamics. By integrating institutional and historical perspectives, we respond to calls for complementary accounts of one of the premises found in the literature that considers globalization as the starting point of PCSR. Second, our exploration of the past and present of PCSR in Colombia provides scholars and practitioners with an overview of the complex state and stakes of CSR in that country. We also discuss the implications of sedimentation for PCSR theory and future research directions. (shrink)

We study the SIS and SIRI epidemic models discussing different approaches to compute the thresholds that determine the appearance of an epidemic disease. The stochastic SIS model is a well known mathematical model, studied in several contexts. Here, we present recursively derivations of the dynamic equations for all the moments and we derive the stationary states of the state variables using the moment closure method. We observe that the steady states give a good approximation of the quasi-stationary states of the (...) SIS model. We present the relation between the SIS stochastic model and the contact process introducing creation and annihilation operators. For the spatial stochastic epidemic reinfection model SIRI, where susceptibles S can become infected I, then recover and remain only partial immune against reinfection R, we present the phase transition lines using the mean field and the pair approximation for the moments. We use a scaling argument that allow us to determine analytically an explicit formula for the phase transition lines in pair approximation. (shrink)

When travelling to a new city, we acquire knowledge about its physical terrain, directions, historical facts and aesthetic features. Engaging in tourism practices, such as guided walking tours, provides experiences of a city that are necessarily mediated and partial. This has led scholars in tourism studies, and more recently in philosophy, to question the epistemological value of city tours, critiquingthem as passive, lacking in autonomous agency, and providing misrepresentative experiences of the city. In response, we argue that the mediated and (...) partial knowledge of a city acquired through city tours is not epistemologically disvaluable. Although city tours involve the transmission of testimonial knowledge, this does not necessarily render tourists as passive and non-autonomous. Instead,tourists have the potential to participate in the generation of their knowledge actively. Moreover, we argue that city tours also provide a tourist with valuable ‘objectual’ knowledge of a city, whichhas the potential to be first-personal and active, and does not necessarily misrepresent the city’s identity. This type of knowledge is valuable both for tourists as credible epistemic agents, and for the city itself, as the knowledge generated by the tour can facilitate an accurate representation of the city and promote social transformation. We conclude by highlighting four further epistemic and ethical implications of our argument. (shrink)

The article examines the process of niche standardization in medical research as an example of democratizing strategies implemented in industry-funded science. I argue that niche standardization can lead to undesirable epistemic and ethical consequences, if the various goals of research are not properly aligned. I examine two examples: the case of Sarafem, approved for the treatment of premenstrual dysphoric disorder in women, and the case of BiDil, approved for exclusive use in African Americans for the treatment of congestive heart failure. Critical aspects in the field of education are currently related to low levels of socioemotional competences and high rates of school dropouts. However, there are no standard practices or guidelines for helping countries to assess and train social and emotional competences. To overcome this limitation, the project Learning to be (L2B) aims to propose a comprehensive model of the assessment and development of social and emotional competences that bring together policymakers, researchers, teachers, school authorities and learners from different participating countries: (...) Finland, Italy, Latvia, Lithuania, Portugal, Slovenia, and Spain. The project attempts to create an international framework for regulating activities and supporting teachers working on the social and emotional competences of the students and to provide tools which can be used across countries. The aim of the paper is to describe how L2B has been developed in Spain by analyzing the contributions of the international framework and extracting the specific needs in the Spanish context. Specifically, we describe two products of the project: a) the process for creating a toolkit, a tool focused on creating activities and materials for helping teachers develop social and emotional competences of students and b) the results of an exploratory study in Spain in which social and emotional competences are assessed and compared to the international framework. First, we explain the definition of social and emotional competences used for creating the toolkit. Second, we analyze responses of Spanish students to questionnaires administered before applying the toolkit in the schools. The paper describes social and emotional competences in Spain and evaluates the overlap between relevant variables in Spain and those used for developing the toolkit, the international tool. Specific needs in Spain are discussed, as well as the contribution of the project for promoting the improved development of students’ social and emotional competences, improving learning outcomes and stronger social cohesion in schools and local communities, as well as the utility of the results for creating new educational policies. The growing body of research on interdisciplinarity has encouraged a more in depth analysis of the relations that hold among academic disciplines. In particular, the incursion of one scientific discipline into another discipline’s traditional domain, also known as scientific imperialism, has been a matter of increasing debate. Following this trend, Scientific Imperialism aims to bring together philosophers of science and historians of science interested in the topic of scientific imperialism and, in particular, interested in the conceptual clarification, empirical identification, and (...) normative assessment of the idea of scientific imperialism. Thus, this innovative volume has two main goals. Indeed, the authors first seek to understand interdisciplinary relations emerging from the incursion of one scientific discipline into one or more other disciplines, such as in cases in which the conventions and procedures of one discipline or field are imposed on other fields; or more weakly when a scientific discipline seeks to explain phenomena that are traditionally considered proper of another discipline’s domain. Secondly, the authors explore ways of distinguishing imperialistic from non-imperialistic interactions between disciplines and research fields. (shrink)

The Workshop of Being offers a meditative analysis of the work of America’s two greatest thinkers on the nature of religious experience.

Human genomics is a translational field spanning research, clinical care, public health, and direct-to-consumer testing. However, law differs across these domains on issues including liability, consent, promoting quality of analysis and interpretation, and safeguarding privacy. Genomic activities crossing domains can thus encounter confusion and conflicts among these approaches. This paper suggests how to resolve these conflicts while protecting the rights and interests of individuals sequenced. Translational genomics requires this more translational approach to law.

Then, the objective is linking this concept with the sense and importance enjoyed in the concept of political participation in the context of his political work, in which the concept of activae civitatis is of an outstanding position. En el trabajo se indagan las posibles ideologizaciones que se alojan tanto en una y otra disciplina, para proponer, a guisa de apuesta, que si se asume la inmersión de ambas en el discurso capitalista se las flexiona a favor del primero. Sólo la subversión del (...) espíritu crítico haría posible remontar los individualismos, previo reconocimiento de la esencia cultural de lo humano, para, desde allí, encontrar las vinculaciones más legítimas posibles, lo que se ejemplifica con los ingenios filosóficos de Margalit y Freud. O Trabalho colaborativo é apontado como um suporte aos desafios existentes no campo educacional, ocupando lugar central em inúmeras políticas educativas. Entretanto, a complexidade do conceito nem sempre é apreendida pelos envolvidos nestes processos. O artigo apresenta resultados de uma pesquisa com o objetivo de dentificar os sentidos da concepção de Trabalho Colaborativo, e a relação que lhe é atribuída com a aprendizagem. Para isso, recorre a opiniões de diretora e professoras de uma escola de educação básica, e professores do (...) ensino superior envolvidos desde o final dos anos 90 na concretização de políticas que valorizam este modo de trabalho docente. Essas opiniões revelaram que o Trabalho Colaborativo é um conceito polissêmico, atravessado pelo discurso do senso comum, pelo discurso político e pelo discurso acadêmico, e resignificado no modo como é concretizado. Na relação com a aprendizagem foi identificada uma divergência de concepções entre os participantes do estudo. Constatou-se ainda que a redução de processos colaborativos é influenciada pela intensificação do trabalho docente e pelos formatos e processos instituídos pelas políticas educativas. Most philosophers would agree that loving one’s romantic partner (i.e., being in love) is, in principle, a good thing. That is, romantic love can be valuable. It seems plausible that most would then think that the process leading to being in love—i.e. falling in love—can be valuable too. Surprisingly, that is not the case: among philosophers, falling in love has a bad reputation. Whereas philosophy of love has started to depart from traditional (and often unwarranted or false) tropes surrounding romantic (...) life, this tendency has not yet reached the analysis of falling in love. The phenomenon continues to be looked at mostly through a compendium of generalisations taken as metaphysical truths—the view of falling in love being akin to “losing one’s mind” or “not being able to think about anything else”. Here, I analyse some of these generalisations to show that although they may reflect some experiences of what falling in love feels like, they wrongly reduce falling in love to two related, but distinct, phenomena: limerence and infatuation. My aim is to refine the current terminology to lay the foundations for a neutral view of falling in love. (shrink)

Our work is a contribution to the model theory of fuzzy predicate logics. In this paper we characterize elementary equivalence between models of fuzzy predicate logic using elementary mappings. Refining the method of diagrams we give a solution to an open problem of Hájek and Cintula (J Symb Log 71(3):863–880, 2006, Conjectures 1 and 2). We investigate also the properties of elementary extensions in witnessed and quasi-witnessed theories, generalizing some results of Section 7 of Hájek and Cintula (J Symb Log (...) 71(3):863–880, 2006) and of Section 4 of Cerami and Esteva (Arch Math Log 50(5/6):625–641, 2011) to non-exhaustive models. The aim of the paper is to clarify the concept of scientific ignorance: what is it, what are its sources, and when is it epistemically detrimental for science. I present a taxonomy of scientific ignorance, distinguishing between intrinsic and extrinsic sources. I argue that the latter can create a detrimental epistemic gap, which have significant epistemic and social consequences. I provide three examples from medical research to illustrate this point. To conclude, I claim that while some types of scientific ignorance (...) are inevitable and even desirable, other types of scientific ignorance are epistemically and ethically flawed and should be prevented. El artículo analiza cualitativamente la relación entre infancia y violencia en el contexto de la guerra civil en El Salvador (1980-1992). La reflexión es vehiculada por el examen de la película Voces inocentes (2004), como una obra socialmente producida y como una representación de la realidad histórica de índole prospectiva. El trabajo destaca el mérito del filme al visibilizar y denunciar la responsabilidad de los sustentadores primarios de la violencia ‒aún hoy impune‒ hacia la infancia salvadoreña, cuyas secuelas psicosociales constituyeron, (...) a la postre, un entorno sociohistórico centroamericano signado por una debacle humanitaria que comenzó hace cuatro décadas, en un tránsito infausto “de la locura a la esperanza”. Para ello, he empleado el marco teórico conceptual sobre la violencia desarrollado por el jesuita vasco-salvadoreño, Ignacio Ellacuría, según el cual, las violencias resultantes solo pueden ser valoradas a partir de la crítica inicial a la violencia originaria de carácter estructural.
